Srinagar, Oct 9: The High Court on Friday directed state not to arrest, Dawood Ahmad Dar, son of Bashir Ahmad Dar, a post-graduate student of University of Kashmir.
Dawood, a resident of Rassu in Budgam was arrested under FIR no. 208/08 registered in police station Beerwah under section 212 RPC, subsequently he was released on bail.
The then SSP, Budgam had forwarded dossier to the deputy commissioner to detain Dawood under PSA in July 2007 and the then deputy commissioner passed the order of detention on January 10, 2008.
Meanwhile, challan was produced before the court against the petitioner and he is being tried for offence under section 212 RPC.
The detention order was never served upon the petitioner and remained unexecuted for almost two years.
While arguing the case, counsel of the petitioner, M Ashraf Wani, submitted before the court that the order of detention cannot be executed at this stage as the purpose and object of the detention was frustrated by the act of the state authorities.
He submitted that the case strictly falls within the guidelines laid down by the Supreme Court.
After hearing advocate, the court directed the state not to arrest the petitioner till next date and the court posted the case for further hearing on October 13.
