Govt amends reservation rules for border dwellers

Social Welfare Department of Jammu and Kashmir has amended reservation rules for border dwellers and backwards area category, an official handout said.

It said the department amended the rules for “personclaiming reservation on backward area or an area near the Line of ActualControl/International Border Jammu and Kashmir.”

   

As per SRO 321, in exercise of the powers conferred bySection 23 of the Jammu and Kashmir Reservation Act 2004 and all other relevantprovisions of law in this behalf, the Government of Jammu and Kashmir herebydirects that clause (III) of Rule 21 of the Jammu and Kashmir ReservationRules, 2005 shall be substituted by the following namely.

 “A person claimingthe benefit on the grounds that he/she belongs to an identified backward areaor an area near the Line of Actual Control/International Border, must establishthat he/she has resided in the area for a period of not less than 15 yearsprior to the date of application and is actually residing in the said area,”the circular reads.

 “A person shall notbe disentitled from claiming this benefit only on the ground that his/herfather or the person on whom he/she is dependent is living in a place which isnot identified as backward or area near the Line of Actual Control orInternational Border on account of his (a) employment or (b) business or (c)other professional or vocational reasons or (d) migration from one place toanother place within the respective Division due to security reasons,” itfurther said.

Similarly, person who has migrated from Kashmir Division forsecurity reasons will not be disentitled from claiming this benefit even ifhe/she has migrated outside the Division/State subject to the condition thathe/ she should have been registered as a migrant with the office of Relief andRehabilitation Commissioner (Migrants), Jammu.
