J&K High Court has quashed detention of eight persons who had been booked under Public Safety Act.
A bench of Justice Ali Muhammad Magrey quashed the detention of Parvaiz Ahmad Bhat of Galliabad HMT Srinagar, Asif Khurshid of Qalamabad district Kupwara and Basit Ahmad Badder of Qaimoh Kulgam after hearing their counsel N A Ronga, M Ashraf Wani and G N Shaheen, and the other side.
Bhat was detained under an order passed by District Magistrate Srinagar on September 8, 2019 while Asif was booked on the order of district Magistrate Kupwara dated 16 August 2019. Badder had been detained under PSA on August 14, 2019.
The court directed the government to release the three detainees immediately from their preventive custody, asking its Registrar Judicial to send copies of the order to J&K Principal Secretary Home Department, Director General Prisons and concerned jail authorities for compliance.
Meanwhile, bench of Justice Tashi Rabstan while disposing of five habeas corpse petitions directed the government to release five detainees from preventive detention immediately.
The court quashed the detention orders of Muhammad Akram Najar of Bicherwa, Kralgund, Kupwara; Muhammad Shafi Yatoo of Awdoora, Sheri Baramulla; Murifat Ahamd Mir of Kandoora Beerwah Budgam; Sajad Ahmad Dar of Mithan Chanpora Srinagar, Shabir Ahmad Sofi of Mazhama Magam Budgam.
The court heard the detainees through their counsel G N Shaheen, G M Shah, Salih Peerzada, Wajib Haseeb and senior advocate S T Hussain and the J&K government through its advocates.
While Najar was placed under preventive detention on August 18 last year by District Magistrate Kupwara, Yatoo was booked under PSA on February 14 by District Magistrate Baramulla.
Mir was taken into preventive custody on 22 May 2019 following an order by District Magistrate Budgam, Dar was detained on July 10 last year. Sofi was detained under PSA on August 28 last year.
The court directed the authorities to release the detainees immediately if not wanted in other cases.
