Judge sacked for ‘misconduct’

Jammu and Kashmir Governor Satya Pal Malik has sacked a judge after the High Court recommended his removal from services for “misconduct”.

The State Law department today issued orders for removal ofJaved Ahmed Naik, Munisff, who was placed under suspension in 2013, following acomplaint against him of causing loss to the State exchequer by charginginsufficient stamp duty.

   

“…the Governor accepted the recommendation of the HighCourt. He has ordered removal of Javed Ahmed Naik, Munsiff (under suspension)from services with immediate effect,” reads the order issued by Law secretaryAchal Sethi.

The High Court, the order said, came to conclusion that theMunsiff be removed from the services under rule 30(vii) of Jammu and KashmirCivil Services (Classification, Control and Appeal) Rules, 1956.

The High Court recommended the action after inquiry officerappointed by it submitted his report. According to the report a show- causenotice was also served upon Naik to make representation on the proposedpenalty.

“The full Court after having considered the representationmade by Javed Ahmad Naik, Munsiff (under suspension) recommended to Governorthe imposition of the penalty of removal from services of the Munsiff (undersuspension),” the order states.

In 2013, the High Court had prematurely retired threedistrict and sessions judges after declaring them as deadwood.
