Art 370, 35A have to go: BJP

State unit of Bhartiya Janata Party on Thursday favoured abrogation of Article 370 and 35A of the Constitution of India.

Article370 and 35A give special status to the Jammu and Kashmir State and decide thepermanent residents of the State.

   

Duringa press conference organised here and jointly addressed by State BJP spokespersonBalbir Ram Rattan and State spokesperson on Kashmir Affairs, Ashwani Chrungoosaid that while Article 370 is a part of the Constitution as “temporaryprovision”, the Article 35A was adopted by the government of the day”scrumptiously” through the Presidential Order in 1954.

 “And,there is a big question mark even on its existence as part of the Constitutionsince it was not included in the Constitution in accordance with Article 368specifying the procedure of amendment in the Constitution,” the BJP leaderssaid.

AshwaniChrungoo said that the Article 35A is an infringement of the Article 14 andArticle 16 of the Constitution.

“Thethreats and statements of blackmail issued in this regard by any politicalfigure or a political party are tantamount to contempt of Supreme Court ofIndia and are calling for anarchy and sedition which is condemnable. In such asituation, law will take its own course,” said Chrungoo.

TheBJP leaders also slammed Congress party for its election manifesto thatpromised to repeal AFSPA if Congress is voted to power.
