Court rejects bail of accused in Kishtwar case

The Special Court has rejected the bail application of Riyaz Ahmed, forest Guard, Devi Dass, member of VDC and Shahbaz Ahmed who were arrested by police in militancy case.

The 3rd Additional Sessions Judge Jammu Subash C Gupta afterhearing APP Sanjay Kohli for the UT observed that there was sufficientincriminating material /evidence, both, verbal as well as documentary collectedby the investigating officer in the matter for drawing a legalinference/opinion by this court that there are reasonable grounds existing forbelieving that the accusation against the applicant/accused and dismissed bailapplications. 

   

According to the police, an FIR was registered vide case FIRNo 268/2019 of P/S Kishtwar against the applicant and others.

On December 2, 2019, a reliable  information was received by the police ofKishtwar that the local militant namely- Tariq Hussain has joined the bannedmilitant organization and made a hide out near Akhala Forest for keeping armsand ammunitions, therein.

On getting this information on the same day,  a CASO was laid in the Akhala Forest area.

On getting information about the movement of the police, amilitant tried to flee from the spot. However, after tactical handing, policesucceeded in capturing the fleeing militant.

On inquiry, he disclosed his identity as  Tariq Hussain son of Amin Wani  of Sounder Dachhan.

“A Rifle 303 and 67 Rounds and other articles wererecovered from his possession.”

On disclosure,  itsurfaced that Shahbaz Ahmed son of Lassa Wani of Karosa Dachhan supplied himthe recovered weapon and he was arrested.

“Shahbaz disclosed the rifle 303 was purchased by himagainst a consideration of Rs 70,000 from one Devi Dass son of  Hari Ram of Janakpur Dachhan.”

“Moreover, 12 bore rifle  recovered from him was earlier supplied  to him by Ramzan son of Mir Zaman of Dangdoru Dachhan.” 

Thereafter,  he wasarrested and on questioning, he stated that it was  provided to him  by Riaz Ahmed son of Abdul Qayoom Sheikh ofSarkoot Kishtwar.  Subsequently, theaccused Riaz was arrested.
