Govt clarify rules on in-situ promotions

Jammu and Kashmir Finance department gave clarification of in-situ promotions subsequent to foregoing functional promotion.

“Jammu & Kashmir Higher Standard Pay Scale Scheme (HSPSS) Rules, 1996 provide that in case an employee after availing in-situ promotion on a particular post, foregoes functional promotion granted subsequently, the employee shall be reverted to his/her original lower pay scale he/she was holding prior to such in-situ promotion under these rules,” a circular issued by department reads.

   

“For this purpose, an undertaking is required to be furnished by the beneficiary employee,” it reads adding, “Finance Department has received a case from Home Department regarding entitlement to in-situ promotion in a situation where an employee after having availed benefit of in-situ promotion did not accept functional promotion subsequently for any reason, but accepted such promotion at some later point of time,”

“The issue has been examined in the Finance Department and it is clarified that if an employee after having availed benefit of in-situ promotion did not accept functional promotion sanctioned subsequently for any reason, but accepts such functional promotion at some later point of time, the subsequent acceptance of the functional promotion shall be construed as acceptance of the Scheme and he/she shall be entitled to restoration of previously availed benefit of in-situ promotion from the due date, however, notionally without payment of arrears.

Future in-situ promotion, if any due, will be granted after completion of 09 years of satisfactory service from the date of acceptance of the notional promotion.

Other terms and conditions with regard to future in-situ promotions, shall remain same as laid down in the said Scheme as amended from time to time.
