J&K government on Tuesday amended J&K Minor Mineral Concession, Storage, Transportation of Minerals and Prevention of Illegal Mining Rules -2016, allowing Panchayats to get short term permits of mining.
“The Panchayats can now get short-term permit up to one hectare for mining in their respective areas after getting permission from Geology and Mining Department,” said a senior official.
The official said the amendment has been made so that the Panchayats, without paying advanced royalty, can carry out mining in their respective areas to provide construction material to people at doorstep.
In this regard, Commissioner Secretary, Industries and Commerce Department, Manoj Dwivedi issued a notification which reads that “…the government makes amendment in the Jammu and Kashmir Minor Mineral Concession, Storage, Transportation of Minerals and Prevention of Illegal Mining Rules, 2016 issued vide notification SRO 105 of 2016.”
The notification says notwithstanding anything contained in the rule, the short term permit up to one hectare shall be granted to Panchayati Raj Institutions and the requirement of payment of advance royalty shall be exempted them.
As per the notification the government may allow the Geology and Mining department to apply and secure clearance like mining plans, environmental clearance, and consent to operate, from the competent authorities on behalf of the Panchayats to be transferred to them later on.
“This provision shall be applicable till 30 September 2021 or till such period as may be notified by the government,” reads the notification.
