J&K Registrar General issues procedure to deal with complaints against judicial officers

Taking tough stance and to provide conducive atmosphere, Jammu and Kashmir High Court on Friday issued certain guidelines to handle complaints of sexual harassment against the Judicial Officers working in the Union Territory.

As per the order issued here by Registrar General, Jammu andKashmir High Court, all the Judicial Officers of Jammu and Kashmir HigherJudicial Service and Jammu and Kashmir Judicial Service were directed to takenote of the certain legal position while dealing with the sexual harassmentagainst the judicial officers. 

   

The complaints of sexual harassment against officers of theJ&K Higher Judicial Service and other Judicial Officers are required to beplaced before the Full Court on Administrative Side for consideration. 

“By virtue of the All India Services (Prevention of SexualHarassment) Regulations, 1998 and Rule 22 of the Jammu and Kashmir HigherJudicial Service Rules, 2009, sexual harassment of women at work place is anact of misconduct by the officer rendering him liable for disciplinary action,”reads the order issued by the Registrar General.

It further insisted that in rule 3B of the Jammu and KashmirGovernment Employees (Conduct) Rules, 1971, sexual harassment of women at workplace is an act of “misconduct by the Judicial Officers other than DistrictJudges” rendering them liable for disciplinary action.

“The Internal Complaints Committees appointed by theDistrict Judges do not have the competence to examine or inquire into thecomplaints of sexual harassment against officers of the J&K Higher JudicialService or the J&K Judicial Service,” reads the order while explaining theprocedure to deal with the complaints.
