In the past nine years, the J&K government has rejected more than 55 percent of the recommendations made by the State Human Rights Commission (SHRC) in different human rights violation cases.
In written reply to a cut motion of CPI(M)MLA Muhammad Yousuf Tarigami, the government Thursday disclosed that 229 recommendations made by the rights panel were put up before the empowered committee since 2009.
Empowered committee is the authority to decide on whether to accept or reject the recommendations.
Of these recommendations, 126 were rejected by the empowered committee.
According to the reply, 58 recommendations were accepted by the committee, while remaining 45 were deferred due to deficient of documents/ reports.
Headed by the administrative secretary Home, the committee comprises of a representative of Law department, director general of police, inspector general of the Criminal Investigation Department and IGPs of Kashmir and Jammu ranges.
The state government has often come under criticism for turning down the recommendations of the rights panel which was created in late 90s.
The State government’s refusal to accept the recommendations is often creating an embarrassing situation for the rights panel. In 2006, its chairperson Justice (retd) A M Mir resigned from the position to protest against non-implementation of the recommendations and growing human rights violations in Kashmir.
Last year, the government turned down the SHRC recommendation for compensation to Farooq Ahmad Dar, who was used as a human shield by Army on April 9 in Central Kashmir’s Budgam district.
On July 10,2017 the SHRC had directed state government to pay Rs 10 lakh compensation to Farooq Dar, saying “such treatment to a human being cannot be accepted in a civilized society.”
The government today also informed the House that 878 cases are pending in the rights panel.
Of 7355 cases / complaints received by the body since its inception, the Commission has made recommendations in 1765 cases, the reply states.
