Why certain politico-legal experts are demanding CBI probe, asks BJP

The Bhartiya Janta Party on Sunday said that it is perplexed to know as to why certain politico-legal experts are demanding CBI probe into the Kathua rape and murder case when they know that the matter is subjudice and the inquiry by the central investigating agency is not possible.

 “Certain politicians who are also legal luminaries know very well that CBI probe is not possible at this point of time because the matter is subjudice. But they are harping the ‘Raga’ of CBI probe. It shows how opportunists they are,” Brigadier (Retired) Anil Gupta said in a statement.

Gupta was specific about the National Panthers Party(NPP) and Pradesh Congress Committee (PCC) leadership as the twin parties according to him are fooling people by demanding CBI probe into the Kathua case.

 “Had these leaders been serious, they should have appealed the high court for a CBI enquiry well before the chargesheet was presented in the appropriate court by the Crime Branch. But alas, they were only trying to score political brownies,” Brigadier Gupta said.

Gupta said that the legal position in the case is crystal clear-not even the lower court hearing the case is empowered to refer the case to CBI. It can only seek evidences from the Crime Branch.

He said, “The authority to transfer the case to CBI rests only with the High Court and Supreme Court that too after the respected courts are convinced of the need of the investigation by the central investigating agency.”

 “Yet the NPP and PCC leaders continue to play with the sentiments of people by assuring them the CBI probe because they are only looking for the political benefits,” Gupta said.

In Kashmir region, Gupta said that separatists and self-seeking politicians are misguiding the youths and encouraging them to launch agitations at the cost of their studies.

“When all the accused are in police custody and judicial process has started, there is no justification for the students to take out protests. But none of the Kashmiri politicians and even separatists have tried to pacify the protests,” Gupta said.

While appealing the students to return to their school and resume their studies, Gupta said, “Now the central government has also announced to issue an ordinance recommending death punishment for the child rapists and the state government has also decided to follow the suit, our leaders should not play politics of hate.
