Anantnag Court sentences man to 3 months jail in cheating case

Anantnag Court has sentenced a man to three months jail for duping youth of money by promising job.

After hearing prosecution and defence counsel, Principal Sessions Judge Naseer Ahmad Dar Anantnag said that prosecution has proved the charges of cheating against the accused Ghulam Mohammad Dar of Giree and is held guilty for the offence.

   

However, the court said that prosecution has failed to prove the charges for the offence punishable forgery against the accused.

It added that it is always the quality of the evidence which is of paramount consideration for establishing a guilty or otherwise and not the quantity.

Court observed that the convict has faced the trial for almost seventeen years.

“From the perusal of the file, it would appear that the conduct of the convict during the course of trial has remained satisfactory and delay in conclusion of trial cannot be attributed to convict which appears to be one of the mitigating circumstances,” court said.

It added that at the time the convict has cheated the prosecution witnesses dishonestly and fraudulently by grabbing money in lakhs from them which he never intended to return.

“Hence, taking into consideration all these facts and circumstances, the convict is sentenced to three months simple imprisonment and fine of Rs 20,000,” court said.

He added that in default of payment fine the convict shall go further one month simple imprisonment.

As per prosecution, the convict was promising government jobs to against consideration amount. He demanded Rs 1,25,000 from the complainant for providing government job to his brother and thus cheated him.
