Centre asks J&K to act against Shah Feasal for remarks on social media

Taking a serious note of his remarks on social media, the government of India has directed the state government to initiate action against Shah Faesal for what it calls as a violation of the service rules governing the All India Services.

Acting on the directions of the Central government, the state government has served a show-cause notice to the IAS officer to explain his position within 15 days. In the notice served to the officer, the General Administration Department of J&K government  has stated that the Department of Personnel and Training , Government of India, has written to it to initiate action against him for his tweets.

   

” …….. The Department of Personnel and Training , Government of India has requested the state government to initiate action against you under provisions of All India Service( Conduct Rules) 1969 / All India (Discipline and Appeal) rules 1969 and to intimate the action taken to the DOPT,” reads the notice served to Faesal by GAD.

He has been given a fortnight to explain his position, failing which the action as warranted under service rules shall follow.

The DOPT is the cadre controlling authority for IAS officers.

The DOPT, in its May 21 communique, had written to the state government that several comments made by Faesal on his twitter account are prima-facie in contravention to the service rules.

In the said communique, screenshots of tweets made by the officer have also been enclosed.

In one such tweets, Faesal has made sarcastic remarks on rape culture in south Asia.” Patriachy+ Population+Illiteracy+Porn+Techonology +Anarchy=Rapistan!

After being served notice, Faesal took to social media again to voice his dissent: “the irony is that  service rules with a colonial spirit are invoked in a democratic India to stifle the freedom of conscience.” And this is not a stunt. I am sharing this to underscore the need for a rule change for the changing times,” he wrote on his Facebook timeline.

Faesal is presently pursuing a mid-career program in the US. Faesal is the second officer of J&K cadre against whom the Centre had requested state government to initiate disciplinary action for their comments/ write -ups.

Earlier, the Centre had requested state to initiate action Basant Rath(IGP traffic) for his write-up published in different newspapers. Feasal, who hails from Lolab area of north Kashmir, topped the 2010 IAS examination and was allocated J&K cadre. He has been quite active on social media and often shared his views on issues concerning people in Kashmir.
