Creation Of Promotional Posts In High Court | HC directs govt to file reply by May 21

Jammu and Kashmir High Court has directed the government to inform it by May 21 with regard to creation of various promotional posts in computer section of the high court.

A Division Bench of Justice Sanjeev Kumar and Justice Javed Iqbal Wani directed senior AAG B A Dar to file an affidavit within 4 weeks indicating the decision taken by the Law Secretary with regard to the creation of posts already recommended by the High Court with all the requisite formalities complete.

   

The direction came after the bench went through the supplementary wherein the Law secretary had said that for want of certain formalities, the proposal could not be considered by the competent authority. “Now the High Court has completed all the requisite formalities and has also submitted the financial implications involved in the creation of posts proposed by the High Court and accordingly the matter is being considered by the competent authority,” the affidavit said.

The court however pointed out that there was one communication of Law Secretary with the reply affidavit which indicated that a meeting was convened on 19 April in the office chambers of Financial Commissioner Finance to discuss issue and take a final decision on the recommendation made by High Court.

“What is the outcome of meeting, however, is not shared,” the court said and sought a fresh affidavit in this regard.

In an earlier order, the High Court pulled up the Law Department for disobedience of its orders with regard to filing the status of recommendations made by the court for creation of various promotional posts in computer section.

Petitioners are appointed as Data Entry Operators in Srinagar wing of high court and have filed a petition seeking creation of four posts of Selection Grade Data Entry Operators, two posts of Section Officer (Computer), two posts of Assistant Registrar-I and One post of Assistant Registrar-II so that they would be entitled for fair chance of promotion.

They seek direction for removal of their stagnation by creating promotional avenues on the analogy as was evolved in the cases of other categories of posts in the court.

The Court has already made its recommendation in the matter and sent the same to the law department for its final call.

The petitioners contend that as per the present status of the posts which are available in Computer Section of the court, there are bleak chances of promotional avenues to the Data Entry Operators of Srinagar wing even though certain creations were made by the authorities.
