HC issues notice to Govt on Faktoo’s plea

The High Court on Wednesday issued notice to government on a plea by Muslim Deeni Mahaz patron, Dr Muhammad Qasim Fakhtoo, seeking directions for examining him medically.   

In his application filed by Dr Faktoo through his counseladvocate Mian Abdul Qayoom, he seeks directions that he be taken to SKIMSSoura, Srinagar, SMHS Hospital or Bone and Joint Hospital, Barzullah.

   

After a division bench of chief justice Gita Mittal andjustice Tashi Rabstan heard advocate Qayoom, senior AAG BA Dar accepted noticeon behalf Director General of Police Prisons J&K and superintendent,District Jail, Udhampur and others.  

The bench however asked Dar to seek instructions from thegovernment about the nearest hospital where Faktoo could be taken and examinedmedically.  The court listed the petitionfor further consideration today on April 11. 

The petition states that languishing in prison for the past26 years, Dr Fakhtoo was arrested in February 1993 and slapped with PublicSafety Act (PSA) first and then subsequently awarded a lifer by the SupremeCourt in January 2003.
