High Court quashes PSA detention of 3

J&K High Court Tuesday quashed detention orders of three persons who were booked under Public Safety Act (PSA).

A bench of Justice Tashi Rabstan quashed detention orders ofadvocate Zahid Ali of Nehama Kakapora, district Pulwama, Muhammad SakindarMalik of Gundpora, Rampora, district Bandipora and Sammer Ahmad Wani ofBeighpora, Awantipora, district Pulwama.

   

While quashing the detention order of advocate Ali, thecourt observed that “failure on the part of the detaining authority to supplythe material relied on at the time of making the detention order, to the detenurenders the detention order illegal and unsustainable.”     

Ali was detained after District Magistrate, Pulwama passedthe detention order against him under PSA on 19 July last year.

While quashing his detention, the court directed therespondents including the Jail Superintendent concerned to release himforthwith provided he was not required in any other case.

Similarly, while quashing the detention of Malik who wasbooked on March 3, 2019, the court directed the government to release himforthwith, provided he was not required in any other case. 

The court quashed the detention of Wani who was booked onAugust 16 this year after observing that the detention of detenu was on thesame grounds, on which earlier detention order had been passed. 

Advocates M Ayoub Bhat, Syed Musaib and Shafqat Nazir represented the petitioners while AAG MirSuhail and DAG Sheikh Feroz appeared for J&K UT.
