With the applicability of the Administrative Tribunal Act 1985 in Union Territories of Jammu & Kashmir, and Ladakh, the High Court has begun the exercise to transfer over 40,000 services related cases to the Central Administrative Tribunal as per the provisions of Jammu and Kashmir Re-organisation Act 2019.
“There are over 40,000 service related cases in courts whichwill be transferred to CAT for adjudication as per the provisions of theRe-organisation Act,” said a senior official.
A notice in this regard has been issued by the RegistrarJudicial, which reads: “The details of the matters have been made available onthe website and if there is any matter left out, the details thereof may befurnished to the Registry by the concerned advocate, department or litigant.”
As per the provisions of the Jammu and Kashmir Re-organisation Act 2019, Administrative Tribunal Act 1985 is now applicable in newly created UTs of J&K and Ladakh.
Hitherto, the Central Administrative Tribunal was onlyhearing service related matters of the central government employees inerstwhile state of Jammu and Kashmir, the cases of state government employeeswere being adjudicated in the High Court.
The employees have demanded that central government shouldestablish individual benches of CAT at Kashmir, Jammu and Ladakh so that theydon’t have to travel outside the UTs to get their service matters redressed.
