The High Court has directed J&K government, National Hydroelectric Corporation (NHPC) and Hindustan Constructions Company (HCC) to respond to a plea seeking Rs 1.5 core compensation to a minor who was critically injured when a HT line fell upon him at Mantrigam in Bandipora district in 2018.
Aatif Irshad Kumar throughhis counsel BA Tak petitioned the Court seeking compensation for treatmentafter he was critically injured when he came under 33,000 KV supply line.
After hearing Atif’scounsel, a bench of Justice Ali Muhammad Magrey issued notice to J&Kgovernment, Commissioner Secretary PWD, Chief Engineer, EM&RE wing Kashmir,Executive Engineer sub transmission division Ganderbal, DC Bandipora, ACRBandipora and District Medical Board Bandipora.
Senior additional advocateGeneral BA Dar accepted the notice on behalf of the authorities. The Court alsoissued notice to General Manager, NHPC and Project Manager, HCC Mantrigam andChairman and Managing Director, Corporate Office, NHPC Haryana.
Aatif, 6, through his father is seeking the compensation onaccount of the injuries suffered by him. The petitioner submitted that the PWDhad installed the HT line near their house in 2008.
The petitioner has placed on record a certificate of DistrictMedical Board, Bandipora which reveals that the minor has suffered 90 percentdisability, suggesting that Rs 30 lakh would be the approximate expectedexpenditure required for the treatment.
With regard to the treatment, the petitioner submitted acertificate issued by the SMHS hospital.
“In order to ensure that the interim compensation is paid tothe petitioner for enabling him to undergo the treatment as suggested by thedoctors, it shall be advantageous to have the immediate response of therespondents,” the Court said.
The Court directed theJ&K government, NHPC and HCC to respond to the plea by7 the minor withintwo weeks. It listed the petition for further consideration on December 17.
