Proposed delimitation in J&K is unconstitutional: JKPM

Jammu and Kashmir People’s Movement (JKPM) state executive member, Advocate Syed Iqbal Tahir has expressed serious concern over the reports about central government’s move to undertake fresh delimitation in the state.

Speaking to a gathering of youth in Anantnag town of SouthKashmir on Wednesday, Tahir, according to local news agency KNS, said theproposed move about fresh delimitation in the state is “totallyunconstitutional”.

   

He said the state legislature has in 2002 frozen thedelimitation process till 2026 by amending the Jammu & KashmirRepresentation of the People Act, 1957, and Section 47(3) of the Constitutionof J&K.

As per this, the delimitation in the state is possible onlyafter the process of Census 2031 shall be completed, Tahir remarked.He said since the exercise of delimitation isfrozen in all States of the country, there was no reason to single out Jammu and Kashmir for any suchexercise.
