Societies in J&K asked to re-register within 45 days

Government has asked the Societies registered before 30 October 2019 in J& K, to re-register within next 45 days or face action under law.

A circular issued by Registrar, Societies and Firms, said that Societies registered under Jammu and Kashmir Societies Registration Act-1998 shall apply for re-registration under the Central Act, now applicable in J&K.

   

“It is hereby directed that the societies registered before 31 October 2019 under J& K Societies Registration Act 1998 (Samvat) 1941 AD are required to re-register under the Societies Registration Act I860 applicable as per the Jammu and Kashmir Reorganization Act-2019 (Notification No 34 of 2019 dated 9th August, 2019-G0l] (sic),” it reads.

It added, the Societies registered under Jammu and Kashmir Societies Registration Act-1998 (Samvat) 1941 AD with this office, shall apply for re-registration along-with the documents within 45 days.

The Societies have been asked to submit the documents both in hard and soft copies. The soft copies, as per circular, can be e-mailed at ao-

industries@jk.gov.in.

The documents to be attached with: audit report of final account for the year 2019-20, two sets of Memorandum of Association.

The applicants have also been asked to submit bye-laws along-with list of managing/executive body as per the provisions enshrined in the Societies

Registration Act, 1860, which is applicable now in J&K.

“All existing Societies registered under J&K Societies Registration Act-1998 (Samvat) 1941 AD need to submit documents and get themselves re-registered under Societies Registration Act 1860 within the period of 45 days from the issuance of this circular, failing which action under rules will be taken against them,” it reads.

On 5 August 2019, the Parliament scrapped special status of the erstwhile state of Jammu and Kashmir and carved it into two Union Territories. Under J&K Reorganization Act 2019, several laws passed by the State assembly of erstwhile J& K were retained and several others scrapped.

The societies in J& K used to be registered under J&K Societies Registration Act. The Act was deleted under J&K Reorganization Act 2019 and now the rules of Societies Registration Act, 1860 are applicable in J&K.
