Sumbal rape: DLSA recommends Rs 1 lakh compensation to minor victim

District legal Services Authority Bandipora on Tuesday recommended paying an interim compensation of Rs 1 lakh to the minor girl allegedly raped by her neighbour in Sumbal locality of north Kashmir’s Bandipora district.

Principal District and Sessions Judge who is also thechairman of District Legal Services Authority Bandipora in an order issuedtoday recommended paying a compensation of Rs 1 lakh to the minor rape victim.

   

“From the perusal of the status report submitted by thepolice, it is established that the incident of alleged sexual violence of 3year old minor girl has taken place as a result of which the victim hassuffered loss/injury arising out of the reported criminal activity,” the judgesays in the order.

“I am satisfied that the victim is entitled to becompensated by way of interim measure of compensation and as such it isrecommended that interim compensation to the tune of Rs, 1,00,000/ (rupees onelakh) shall be paid to the victim in terms of Section 545-A Cr.P.C read withJ&K Victim Compensation Scheme, 2013 (herein referred to as Scheme of 2013provided under SRO No. 229 dated 23rd of April, 2013).”

The order further reads: “However, an undertaking shall befurnished on behalf of the minor victim before the disbursal of thecompensation amount to the effect that if the trial court while passingjudgment at the later date, order the accused to pay an amount by way ofcompensation under Sub Section 3 of Section 445 of the Act, the victim/claimantshall remit the amount ordered, equal to the amount of compensation or theamount ordered to be paid under Sub Section 3 whichever is less”.

On May 08 a minor girl was raped by her neighbour afterbeing lured to a nearby school in Sumbal locality. The incident triggeredwidespread protests across Kashmir.
