Liyaqat Shah episode is an eye opener for all; will any action follow?
On April 2nd , 2013, I had written a piece titled “ The Rehabilitation Phenomenon”. I had exhibited my anger towards Delhi police and other security agencies who had branded a 47 year old Kupwara resident Liyaqat Shah, not only as a terrorist but he was also accused of planning a “Fidayeen attack”, to be carried out in the New Delhi around March 2013 .
During that time Liyaqat’s arrest had become a matter of discussion on all the news channels, print and social media. The top brass of Delhi Police had claimed that he was arrested from a private guest house in Jamia Masjid area of old Delhi along with an AK 56 rifle and other ammunition .
Under Rehabilitation Policy
J&K Government had already made it clear to the Home Ministry (MHA) officials in New Delhi that Liyaqat Shah had applied before the competent authority in the State under its “Rehabilitation Policy” meant for all those people who wanted to return back to J&K from Pakistan or its controlled areas across LoC. Liyaqat, a resident of Kupwara district in North Kashmir also wanted to return back to his native place after spending many years in Pakistan where he had actually gone for arms training in 1990s, but later-on preferred to live a normal life in Pakistan. Even the former Chief Minister Omar Abdullah had acknowledged this fact that Liyaqat wanted to return under the rehabilitation policy. When this guy was taken into custody by the Delhi Police, Omar Abdullah had asked the then Home Minster Susheel Kumar Shinde to get this probed through National Investigating Agency (NIA) which has now declared him as an innocent man.
NIA indicting Delhi Police?
The National Investigating Agency (NIA) which conducted the investigation in Liyaqat’s case has recently submitted its report to the Ministry of Home Affairs (MHA). The MHA according to a news report carried in many national dailies including Times of India has indicated to take strong action against the Delhi Police officers who had allegedly framed Liyaqat Shah in fake terror charges. Media reports say that a report has been prepared by National Investigation Agency (NIA) which speaks about the alleged involvement of five officials of Delhi Police and one of them being an officer of the rank of Deputy Commissioner of Police (DCP). The said officers had fabricated charges against Liyaqat Shah in March 2013 when he was returning from Pakistan along with his family via Nepal. Reports say that NIA has already filed a charge sheet against an informer for Special Cell of Delhi Police. A separate report has been sent to the Ministry of Home Affairs (MHA) about the involvement of Pathan and other Police officials.
We have dozens of examples with us where the innocent Kashmiri youth became the direct victims of Police in one way or the other. As Liyaqat’s case was positively highlighted by media and J&K Government also authenticated his non involvement, thus he was saved from their clutches. The civil liberty groups, human rights defenders are constantly watching all these developments and they too are hopeful that all the accused police officials would be sent behind the bars as soon as possible. Will other such similar cases be also probed by NIA, CBI or any other investigating agency wherein innocent youth were branded as terrorists? Will Modi Government which talks of “Sabka Saaath Sabka Vikaas” be able to deliver justice to all these victims ?
