J&K High Court Bar Association Monday suspended a lawyer, accused of fabricating bail order, from basic membership of the fraternity.
On January 8 police had arrested two lawyers for allegedly making a forged bail order of High Court for release of their clients from jail.
The accused lawyers Aamir Masoodi and Musavir Ahmad Mir, as per police, had forged a bail order for the clients whose bail application was rejected by trial and appellant court in Budgam.
“Taking a strong notice of the events which have led to the arrest of two lawyers Musavir Ahmad Mir and Aamir Masoodi, the executive body Bar Association has decided to suspend one of them namely Aamir Masoodi from basic membership of the Bar Association till outcome of the criminal case registered against him,” said Muhammad Ashraf Bhat, general secretary of the Association.
He added that another accused lawyer Musavir Ahmad Mir was not a member of the Association “We have decided that he will not be allowed to avail any of the facilities of the Association, in any manner whatsoever till the outcome of case,” he said.
As reported earlier, the fake bail allegedly forged by these two accused lawyers had fake stamp and signature. Their clients were released by the police on production of this fake order.
Bhat said that the executive body of Association discussed the matter in detail. “The matter involves integrity of an institution and a trust between a lawyer and a client. The offence, a lawyer is accused of, and the events that led to his arrest, are serious in nature involving the integrity of an institution,” he said.
The matter came to light when Police Station Magam in Budgam wanted to file a charge-sheet before the competent court against the clients of these two lawyers who were released from jail after production of the fake release order.
As per the provisions of law, the investigating officer of the case was required to submit a copy of bail bonds furnished by sureties of accused, along with charge sheet.
As he went to High Court to get the copy of bail bonds, he came to know no such bail order was issued by the High Court in this case. On the directions of High Court, Shaheed Gunj police registered the case (vide FIR number 83/2017) and took up the investigation. The accused lawyers were arrested on 8 January 2019 and are presently in police custody.
