Court rejects bail to lawyer accused of forging HC order

A local court here Thursday rejected bail to a lawyer accused of forging a High Court order.Two accused lawyers Peer Aamir Masoodi and Musavir Ahmad Mir, as per the police, had forged a bail order to get released their clients whose bail was rejected both by the trial court as well as the appellate court in Budgam. The accused lawyers, according the

police, had forged the bail order using fake stamp and signature and passed it as a “genuine order issued by the High Court”. Their clients were released by the police on production of the fake order. Both the accused lawyers are in the police custody.

   

“The application for grant of bail to the accused (Musavir Ahmad Mir) is premature, as such dismissed,” said the court of chief judicial magistrate, Srinagar, Aijaz Ahmad Khan.

In its detailed order, the court observed that the allegations against the accused are that he along with other person “are involved in the fabrication of a bail order and managing release of their clients from the judicial custody through it”.

“This act of the accused had sent shocking signal in the society. (The) act is purported to have been committed inside the temple of justice,” the court said. 

The court added that the case diary reveals that a “number of skeletons are coming out and much more are to be unearthed in this case”.

The court said the investigation into the case is at infancy and the judgments relied upon by the counsel for the accused are not applicable at this stage.

While referring to various provisions of law and the Supreme Court judgments, the court observed there is a need to get rid of the rot from the system and that too from the temple of justice, as such, strict approach needs to be adopted in dealing with such cases otherwise society will lose faith in the system.

Earlier, senior prosecuting officer Abdul Majeed Mir vehemently opposed the bail application.

Shaheed Gunj police state has booked both the accused.
