Handicapped person detained for instigating stone throwing: Police tells SHRC

Jammu and Kashmir police on Saturday said that they’ve detained a handicapped person in the frontier district of Kupwara for instigating stone throwing in the area.

The police filed a reply on Saturday after a complaint was filed by Wali Muhammad Mir (42), son of Ghulam Muhammad Mir, resident of (Kuligam) Khurhama Kupwara before the State Human Rights Commission (SHRC) through human rights activist Muhammad Ahsan Untoo.     

   

Wali in his complaint had alleged that the police arrested him on 5 April 2018 when he was on way to buy the bread and tortured him. He said in his complaint that unknown persons had hoisted Pakistani flag in the area and police ordered him to bring down the flag. “I told them that I can’t walk and how can I bring down the flag,” his written complaint states. “They bundled me inside the vehicle and beat me in the police station”.

In its reply to SHRC, the police said that in view of the strike, a police party was deputed to Bazar Khurhama for maintaining law and order. “The party reported back along with one Wali Muhammad Mir and stated that during duty at Khurhama Chowk the said person was found provoking the youth for stone pelting,” reads the written reply.  “They said the person was restrained from such activities, but continued to provoke the youths. There was every apprehension of breach of peace on the spot”.

The said person was detained under preventive measures U/S 151,107 CrPC and a report in this behalf is lodged in the police post Khurhama, reads the reply. He was later released on bail.

The reply further adds that the said person also has another FIR registered at police station Lalpora, Kupwara “The said person being handicapped has not been arrested in the said case so far. He was taking advantage of being handicapped and is trying to breach the peace by provoking the youths. So he was detained under preventive measures,” the police reply states.
