Srinagar, June 29: The Juvenile Justice Board (JJB) Srinagar Tuesday directed a local news portal owner to make himself present in person before it on Wednesday and explain why action under law should not be taken against him.
The notice was issued by JJB comprising Principal Magistrate JJB Srinagar Touseef Ahmad Magrey and two members Asima Hassan and Khair-ul-Nisa after taking cognisance of a news report wherein the news portal had revealed the name of the juvenile.
The JJB has also directed the news portal owner to remove the news from the website.
On 27 June, the JJB had directed Passport Sewa Kendra Jammu to issue passport in favour of a juvenile who is going under trial in BOPEE scam case.
It had said that during the pendency of inquiry, the child cannot be denied of her legal, constitutional and fundamental right.
“This is in reference to the news item, 'Juvenile Justice Board Srinagar directed the SSP CID Jammu to verify the repo of applicant (child) for issuance of passport to the Passport Sewa Kendra' published by you on 27 June 2021 at 3:36 pm that went viral on the Social Media platforms,” the notice reads.
“It is an offence against a child In contravention to the provisions of Sub-Section (1) of Section 74 of The Juvenile Justice (Care and Protection of Children) Act, 2015 and the Model Rules, 2016 which strictly prohibit the disclosure of identity of children and is punishable with imprisonment for a term which may extend to six months or fine which may extend to Rs 2 lakh or both,” it read.
The notice read, "You have disclosed the identity of the child which has resulted in stigmatising the child and has also defeated the purpose of the Juvenile Justice (Care and Protection of Children) Act, 2015 and the Model Rules, 2016."
It read: “This notice is served upon you for affording an opportunity of being heard in person and to file the written reply as to why you may not be penalised for unconstitutional and unlawful action on your part and why concerned competent authority may not be directed to de-register your publications which contravene the provisions of law. You are as such directed to ensure your presence before this board on 30 June 2021 at 12 noon. In the meantime you are directed to remove the news item from your portal immediately."
