Asiya Andrabi, aides involved in waging war against GoI: NIA

National Investigation Agency (NIA) in its dossier against the Dukhtaran-e-Milat chief AsiyaAndrabi and her two close associates has stated that the trio had entered into a “criminal conspiracy” to wage war against the Government of India, adding that they were also using cyberspace to solicit support of Pakistan.

According to a copy of dossier prepared by the NIA against DeM chief and her two associates FehmeedaSofi and NahidaNasreen, the central government received credible information that Asiya and her aides were “actively running a terrorist organisation named as Dukharan-e-Milat which is  proscribed under the first scheduled to the unlawful activities (prevention ) Act, 1967”. 

   

All the three have been lodged in New Delhi’s Tihar jail.

“They were using various platforms to spread insurrectionary imputations and hateful speeches and endanger the integrity, security and sovereignty of India besides spreading communal disharmony between communities in India,” the dossier reads.

The dossier states that considering the gravity of the offence, the Ministry of Home Affairs (MHA) Government of India, vide its order number 11011/28/2018/NIA/CCTR division, dated April 26, 2018 directed the NIA to investigate it. 

“Accordingly, NIA has registered an FIR as NIA case number RC-17/2018/NIA/DLI under section 120 B, 211, 121 A, 124 A, 124A, 153A,153A, 153Band 505of IPC and section 18, 20, 38 and 39 UA (P)Act against  accused persons Asiya and her two associates,” the dossier reads.

The dossier further states that during the course of investigation, the role of the accused was confirmed. 

“A significant number of incriminating videos, photos, and documents were collected in which these accused persons implicitly and explicitly advocate secession of Jammu and Kashmir from the Union of India besides spreading enmity, hatred and ill will between different communities on the ground of religion,” the dossier reads. “They have uttered imputations that prima facie appear prejudicial to maintenance of harmony. Asiya along with her associates have also entered into a criminal conspiracy to wage war against the Government of India.”

The NIA dossier states that Asiya’s house was searched by the J&K police at Iqbal Colony, Soura on April 6 and it was found that the “premises was being used as the office of Dukhtanran-e-Milat”.

“During search, police seized several incriminating documents pertaining to proscribed organisation that include letter pad of DeM, identity cards of FehmeedaSofi and NahidaNasreen issued by the DeM, recruitment forms of Tehreek-e-Dukhtaran-e-Milat along with several other incriminating documents,” the dossier reads. 

“Many electronic gadgets which include 11 mobile phones, two tabs of Micromax, five SIM cards of different companies, four CDs, one pen drive, monitor inbuilt computer system, one CPU and one DVR CCTV box.”

The dossier states that the copies of documents were obtained by the investigating officer (IO) of NIA for the case. 

“The present investigation has so far revealed that the accused persons namely Asiya, Fehmeeda and Nahida are found involved in conspiracy and acts to severely destabilise the sovereignty and Integrity of India,” the dossier reads. “By their activities on cyberspace, they were running a concerted campaign to solicit support of Pakistani establishment which inter-alia includes arranging support from militant entities from Pakistan.”

The NIA has stated that the involvement of Asiya and her aides needs further investigation and for the purpose, interrogation of the accused persons has become a necessity. The investigation agency has also sought 15 days police custody of all the three “to unearth the larger conspiracy”.
