High Court asks state govt to release salary of a casual labourer

The High Court on Thursday directed the government to release salary in favour of a casual labourer, Shahbaz  Shafi Ganai.

Hearing a plea by Ganai through his counsel, Rizwan ulZaman,  a bench of Justice Ali MuhammadMagrey directed Commissioner Secretary Animal Husbandry Department to releasefunds to Director, Animal Husbandry, Kashmir, within a week asking the latterto release the same as salary in favour of Ganai.

   

“In the event, it is noticed that funds are not released forimplementation of the Court Order, the salaries of the Commissioner Secretary,Animal Husbandry Department and Director, Animal Husbandry Department, KashmirSrinagar shall stand stopped,” Court said.

The court asked the concerned Treasury Officer as also BankManager; wherever details of the accounts of the two authorities are maintainedto ensure that their salary bill for the month of July is not entertained.

 The petitioner hadalleged violation of final order passed on 13.02.2015 in SWP No 221/2015wherein the respondents were directed to take a decision regarding absorptionof the petitioner in the Government service.

 The authorities werefurther directed not to disturb the position of the petitioner and pay hissalary regularly till the decision in the matter was taken. 

 In the status reportfiled by the Director, Animal Husbandry, Kashmir it was stated that the case ofthe petitioner along with other casual labourers of the department standsalready uploaded on the website devised by the Finance Department for thepurpose of regularization.

The status report further revealed that the present positionof the petitioner stands maintained. However, earned wages of the petitionerhad been partly released and for the remaining part requisition has been madewith the Administrative Department for release of funds.
