Govt bans all adhoc, contractual appointments

J&K government on Friday put a complete ban on engagement of casual, seasonal, adhoc, consolidated, contractual, need-based and daily-rated workers.

A General Administration Department (GAD) circular said thatwith the commencement of section 14 of the Jammu and Kashmir Civil Services(Special Provisions) Act, 2010, no appointment shall be made by any departmentagainst any post on adhoc or contractual or consolidated or temporary basis andall vacant posts shall be filled up strictly in accordance with the rulesgoverning the recruitment to the respective services or posts.

   

It said that in case where any appointment is made by anofficer in contravention to the provisions of sub-section (I), he shall beliable to disciplinary action under rules and the salary drawn by suchappointee shall be recoverable from the defaulting officer as arrears of landrevenue.  

The circular further stated that the orders issued videgovernment order number 43-F of 2015 dated March 17,  2015 read with corrigendum issued vide numberA/Misc/2015/391 dated March 20, 2015 regarding the withdrawal of powers from administrative departments toengage casual labourers, shall continue to remain in force.

“Any new engagement of a CSLW is any department can only bemade with the prior approval of the Chief Minister through the FinanceDepartment,” it said.

It is accordingly impressed upon all the officers of theState government to strictly adhere/observe the statutory rules and codalprovisions in letter and spirit and ensure that (i) any person appointed onadhoc/contractual/consolidated/ temporary basis after the imposition of ban on suchengagements (i.e. on or after 29.04.2010) in contravention of the provisions ofthe Act shall forthwith cease to continue; (ii) any person engaged ascasual/seasonal/need bases worker after imposition of ban on such engagements(i.e. on or after 17.03.2015) without specific approval of competent authorityor without following due procedure shall also cease to continue forthwith; and(iii) in the event of failure to comply with these instructions, the concernedofficer(s) will be held personally responsible and the amount due or paid tosuch irregular appointee(s)/engage(s) shall be recovered from the personalemoluments of the officer(s) concerned who had made/continued suchengagements(s) in violation of the rules, orders or codal procedures, besides thetermination of all such irregular appointment(s)/engagement(s).

Meanwhile, all the Administrative Secretaries, DivisionalCommissioners, Heads of the Departments, Deputy Commissioners have been askedto ensure strict compliance of the instructions issued by the governmentregarding the fresh casual and consolidated engagements.
