The sacked policeman Tilak Raj, one of the accused in Kathua rape-murder case, has challenged his dismissal from service with the High Court admitting the petition and listing it for hearing on Friday.
The accused, Constable Tilak Raj, was dismissed from services after his involvement came to fore in the rape and murder case at Rasana, Kathua where a minor girl from Bakarwal tribe was abducted, tortured, raped and finally murdered.
The defense lawyer, AK Sawhney, on behalf of constable Tilak Raj, Thursday filed a writ petition in the Jammu and Kashmir High Court challenging that “dismissal of accused from services is an arbitrary order” issued by Director General of Police Shesh Pal Vaid.
“No notice was issued to accused, no inquiry was conducted and the accused was dismissed from services,” Sawhney said adding, “The dismissal of accused from services is against the principles of natural justice”.
Sawhney asserted that the dismissal order was against the Supreme Court order, discriminatory and arbitrary and therefore, “we have challenged it in the High Court.”
The matter will be taken up for hearing in Jammu and Kashmir High Court, Jammu Wing, by Justice MK Hanjura on Friday, the sources said.
Since the case is sub judice with a court in Punjab, the defense lawyer yesterday sought permission from the Pathankot district and sessions court to file writ petition in Jammu and Kashmir High Court challenging the dismissal order of the accused.
The Pathankot court, which is hearing the Kathua rape and murder case on day-to-day basis and in-camera, granted permission after which the writ was filed today.
