HC gives nod to common exam for law officers’ posts

The High Court on Friday gave a nod to the Jammu and Kashmir Public Service Commission to hold a common examination for the posts of district litigation officers and assistant legal remembrancer as per the notification the Commission has already issued.

Modifying its single bench order, a division bench of Acting Chief Justice Alok Aradhe and Justice M K Hanjura, however, held that the issue involved in the plea required consideration therefore there is need to safeguard the interests of the candidates who have approached the single bench.

   

“Accordingly the ad-interim order dated 24-5-2018 passed by the learned single judge is modified and it is directed that the appellant shall be at liberty to hold the written examination,” the court said.

The Court however directed the PSC not to declare the result of the examination without the permission of the single bench. The court ordered for listing the matter before the single bench on June 6. 

The directions came after Azhar-ul-Amin on behalf of the PSC pleaded that the aggrieved candidates have approached the court on 24 May after a period of nearly one and a half month when the PSC issued the notification for conducting the examination for the posts of district litigation officers and assistant legal remembrancer. 

He said the PSC has made all the arrangements for holding the exam and in case the examination is postponed, it will amount to wastage of the public exchequer.

Some aggrieved candidates had approached the court against the notification issued by the PSC on 10 April, 2018, announcing a common examination for two different posts advertised through two different notifications. The candidates had said that they have applied for both the posts and holding of a common examination will jeopardize their rights.
