Court rejects bail in forgery case

Court of Chief Judicial Magistrate (CJM) Srinagar rejected bail plea of a person accused of forging J&K Bank appointment orders, using fake seal and signature of its chairman, and duping scores of job aspirants.

Afterhearing additional public prosecutor Abdur Rashid Mir, and the defence counsel,CJM Srinagar, Gowher Majid Dalal, said that prima facie, evidence on recordsuggests that the accusation against the accused cannot be doubted.

   

Thecourt said prima facie it appears that the accused Abdul Majid Mir, a residentof Kaloos Kupwara, has cheated innocent educated unemployed youth and dupedtheir parents by taking hefty amounts against “false and forged appointmentorders”.

“Theaccused has committed such offences professionally and forged the signatures ofthe chairman J&K Bank,” the court observed, adding, that if the accused isenlarged on bail “there are chances he will repeat the offence.”

Thecourt said the amount of money that the accused has taken from the innocentyouth “has not been recovered yet and in this regard investigation is inprogress”.

Whiletaking police report and evidence into consideration, the court observed thatthe antecedents of the accused, his involvement in other criminal cases and hisconviction in a cheque bounce case are “relevant” for refusing the bail to theaccused.

Thecourt observed that accused is involved in the commission of offences whichhave great impact on the society. “Letting (off the) accused on bail in suchcase would definitely have deleterious effect on (the) mind of general publicand would encourage reoccurrence of such crimes.”

“The bail application isdisallowed,” the court said.

Earlier, APP Abdur RashidMir vehemently opposed the bail application, arguing that the accused hadreceived hefty amounts from job aspirants after he “projected himself aspersonal secretary (PA) of the chairman of J&K Bank”.

Mir submitted that theaccused had received Rs 29 lakh from 13 individuals hailing from Tral, Pamporeand Pulwama areas and handed over 11 fake appointment orders to them.

He submitted that theaccused had prepared fake appointment orders. “His signatures on these appointmentorders have been confirmed by the FSL Srinagar,” he said.

“The seal and otherinstruments used in preparation of appointments orders are yet to be recovered.In this regard the disclosure is expected from the accused,” he pleaded.
