PERSONS WITH BENCHMARK DISABILITIES | Government issues revised guidelines for implementing reservation

Jammu: The government issued revised guidelines for the implementation of the reservation to persons with benchmark disabilities on Saturday.

As per an order issued by Social Welfare Department, the government had amended the Jammu and Kashmir Reservation Rules, 2005 through a notification issued on 20 April 2020 and enhanced the horizontal reservation from 3 percent to 4 percent for physically challenged persons in terms of the Rights of Persons with Disabilities Act, 2016 against each benchmark disability.

   

The Jammu and Kashmir Rights of Persons with Disabilities Rules, 2021 were notified on 15 March 2021. The lists of posts identified for persons with benchmark disabilities under Right of Persons with Disabilities Act, 2016 were notified vide government order No 59-JK (SWD) of 2021 dated 15 April 2021 and Government order No 142-JK (SWD) of 2021 dated 14 October 2021.

The order mentioned, “Whereas vide Annexure B to government order No 62 of 2001 dated 13 March 2001 the guidelines for implementation of the reservation to persons with benchmark disabilities in terms of the existing acts and rules applicable at that point of time had been notified. However, with the increase in the quantum of the horizontal reservation to physically challenged persons, these guidelines are required to be amended.”

The Department of Personnel and Training, Government of India, on 15 January 2018 issued instructions including the register and roster to be followed in providing reservation to disabled persons with benchmark disabilities.

“The General Administration Department and the Department of Law, Justice and Parliamentary Affairs on 13 October 2021 advised that the necessary amendments are required to be carried out in the relevant order issued by the department in this regard. Hence, the guidelines for implementation of the reservation to persons with benchmark disabilities are hereby issued afresh in supersession of Annexure B to the government order No 62-SW of 2001 dated 13 March 2001,” read the SWD order.
