SELECTIONS IN 3 SUPER-SPECIALTY DISCIPLINES|Despite High Court direction, SKIMS yet to declare result

In violation of the directions issued by the High Court one and a half year ago, the SKIMS has not declared the result of selected candidates who had participated in the selection process for the post of assistant professor in three disciplines of the tertiary care hospital.

In a comprehensive judgment, the High Court on October 10,2017 had directed the director SKIMS to declare the result of candidates whohad applied for the post of Assistant Professor in the departments ofNeurology, Plastic Surgery and Neurosurgery – which are Super SpecialtyDisciplines.

   

After it declared the 5 petitioner candidates eligible forthe post of assistant professors, the court had directed the SKIMS to declaretheir result and finalize the selection process. Pursuant to interim directiondated 23-11-2016, the petitioners were admitted by the court to selectionprocess.

In terms of advertisement notice no 7 of 2016 issued on May5, 2016, the SKIMS had specified 25 September 2016 as the last date forsubmission of applications along with certificates while the effective date upto which the requisite experience was to be completed was mentioned as June 30,2016.

In the advertisement notice it was mentioned that formedical candidates (Super Specialty Disciplines) who have three year M Ch or DM degrees do not require experience.

The petitioners were however informed by the SKIMS administrationthat the screening committee constituted by the Government noticed that theywere not eligible for the posts on account of requisite qualification/degree ofDM having been completed after cutoff date. Aggrieved of the same, they filedthe writ petition.

While disposing of the petition, the High Court held that the five petitioners have respectively done their D M or M Ch well before the cut of date of 25 September 2016- the last date fixed for the submission of the applications. “Respondents in their reply without any justification have questioned the eligibility linked with the experience of the petitioners.

The communications as sent to the petitioners by the Senior Administrative Officer (Member Secretary Screening Committee) that they lack the eligibility is totally misplaced and without any basis running totally contrary to the condition of the Advertisement Notice,” the court had said.
