Pulwama girl’s suicide case: Court declines bail to accused

A local court here rejected bail application of a man who had allegedly uploaded photographs of a girl on social media “instigating her to commit suicide”.

Chief judicial magistrate Pulwama Javid Alam rejected thebail to the accused.

   

As per the prosecution, police last month arrested theaccused from Check Kellar Shopian after the family of the slain girl lodged acomplaint with Pulwama police station.

The police station had on 7 March 2019, received a writtencomplaint from the father of the slain girl alleging that his daughter hadfriendly relations with the accused.

He had alleged that the accused had uploaded photographs ofhis daughter and had threatened to tarnish her image.

“The girl could not tolerate the act of the accused andended her life,” the father had complained.

On receipt of the compliant, case FIR 26/2019 U/S 306 RPCwas registered in police station Pulwama and investigation taken up.

The accused was arrested and his mobile phone seized. Thephone was sent to forensic laboratory for retrieval of data.

In his bail application, the accused pleaded that he wasarrested by police on “false” and “frivolous” allegations.

“The accused is innocent and has not committed any offenceduring his life time. The accused cannot be punished by keeping him in thepolice custody,” the counsel pleaded before the court.

After hearing both the sides, the court observed, “It wouldbe premature to admit the accused to bail at this stage in view of the natureof offence. The application is accordingly disposed of and shall be consignedto records after due completion.”

Referring to various provisions of law and the Supreme Courtjudgments, the court said the basic question while deciding bail application iswhether grant of bail would thwart course of justice.

“There cannot indeed be any inflexible rule governing thegrant of bail. Each case has to be decided on its own facts,” the courtobserved.

The court said that uploading of pictures on social media”has now become a tool for the commission of the offences especially forblackmailing of girls/women and social networking sites have created chaos inthe society which needs to be checked so that the writ of the law andpreservation of social fabric is ensured.”
