Death of Srinagar Youth in Kathua | Court directs Police to appear with case diary at next hearing

Srinagar, June 12: The Court of Mobile Magistrate Traffic Kathua Saturday directed the SHO Police Station Kathua to appear with a case dairy in the death of a Srinagar youth in Kathua that his family alleged to be a murder.

The court was hearing an application moved by the family via virtual mode wherein the family alleged that the deceased Muhammad Huzaif of Saria Balla Srinagar was killed on 10 September this year at Magarkhad, Kathua “and it was a pre-planned murder”.

   

The court issued directions to Police after the family of the deceased represented by counsel Ishtiyaq Ahmad Khan expressed its ‘dissatisfaction’ over the status report filed by Police before the court.

The Police on Saturday submitted before the court that a case under FIR No 284/2021 had been registered against the accused for the offences of rash driving, causing hurt by rash acts, and causing death by negligence.

However, Khan pleaded before the court that Police had not filed a status report as per the contents of the application moved by the family.

In its application filed before the court, the family of the deceased is seeking registration of FIR against the accused for the offence of the murder.

“I would like to furnish detailed arguments on this (status report filed by Police) and need a time for same,” counsel Khan submitted before the court, adding that he was not satisfied “as the Police report is not as per the contents of the application moved by the family of the deceased”.

The court allowed counsel Khan to furnish further arguments on 22 June.

The court further directed the SHO to appear along with the case dairy file on the next date of hearing and also file any further report in the case, if any.

Earlier, counsel Khan pleaded before the court the facts and circumstances connected with the occurrence “suggest that the deceased was brutally murdered under a well-thought conspiracy, plan and strategy”.

He submitted before court that Police in the initial FIR had mentioned rash driving but the murder angle of the incident was not investigated.

Counsel Khan prayed for registration of FIR for the offence of the murder and monitoring of investigation by the court.
